The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

People sometimes explain behavior by appealing to an essentialist concept of the self, often referred to as the true self. Existing studies suggest that people tend to believe that the true self is morally virtuous; that is deep inside, every person is motivated to behave in morally good ways. Is this belief particular to individuals with optimistic beliefs or people from Western cultures, or does it reflect a widely held cognitive bias in how people understand the self? To address this (...) question, we tested the good true self theory against two potential boundary conditions that are known to elicit different beliefs about the self as a whole. Study 1 tested whether individual differences in misanthropy—the tendency to view humans negatively—predict beliefs about the good true self in an American sample. The results indicate a consistent belief in a good true self, even among individuals who have an explicitly pessimistic view of others. Study 2 compared true self-attributions across cultural groups, by comparing samples from an independent country and a diverse set of interdependent countries. Results indicated that the direction and magnitude of the effect are comparable across all groups we tested. The belief in a good true self appears robust across groups varying in cultural orientation or misanthropy, suggesting a consistent psychological tendency to view the true self as morally good. Este artigo oferece uma nova reconstrução para os argumentos do famoso segundo capítulo de Word and Object de Quine e sua idéia da Tradução Radical . De acordo com essa abordagem, o maior alvo de Quine é a noção de composicionalidade como sendo o elemento fundamental para qualquer teoria do significado. Em poucas palavras, não poderia haver nenhuma “teoria do significado”, para Quine, simplesmente porque a noção de composicionalidade deveria ser rejeitada como a concepção central da semântica. Além disso, tomamos (...) o cuidado de diferenciar argumentos empíricos de argumentos a priori de natureza modal. Esses últimos constituem-se no que propomos chamar de Teorema do Automorfismo de Quine , a idéia de que há maneiras alternativas de se reconstruir a estrutura gramatical de qualquer língua incluindo predicação e que poderiam manter invariantes todas as nossas predisposições para comportamento verbal sob quaisquer estados de coisas, atuais ou meramente possíveis. Em nosso entender, é esse teorema que determina fundamentalmente a rejeição da composicionalidade por Quine e, assim, de todas as teorias do significado. (shrink)

Trata-se de capítulo de um livro sobre a noção de "substância" na história da filosofia e contém uma discussão sobre a noção ordinária de "corpo" do ponto de vista da filosofia analítica.

Para solucionar a questão “sobre o que há” levantada por Quine, e realizar a tarefa de compreender de forma exauriente as muitas unidades ontológicas que povoam a grande província do Ser, propomos como alternativa à ontologia punteliana, uma nova ontologia designada de “Ontologia Estrutural” (OE). Tal ontologia parte de bases teóricas sistemático-estruturais, mas desemboca em uma visão diversa em que co-subsistem unidades factuais estruturadas, configurações estruturais (dinâmicas), bem como unidades ontológicas aparentes (objetos), todas englobadas pela subdimensão temporal que as interconexiona, (...) compreendida esta como uma subdimensão (interna) da macrodimensão do Ser. Nesse sentido, começamos situando a temática ontológica na discussão filosófica atual a partir de uma chave quineana; prosseguimos apresentando um conceito de verdade derivado de nossa leitura da filosofia punteliana, o qual constituirá o ponto de ligação entre linguagem e mundo. Na sequência, mostramos como do conceito de verdade trazido à lume, após uma breve incursão na semântica filosófica, chegamos ao campo ontológico a partir das categorias ontológicas de estrutura e estado ontológico. Ao final, delineamos, em seus caracteres gerais, a nossa ontologia estrutural, compreensiva de noções ontológicas próprias que dão novos rumos à compreensão filosófica desta grande temática. The aim of this paper is to study a set of three issues related to the understanding of partial justice and partial injustice as character dispositions, namely the distinctive circumstance of action, the emotion involved therein and the pleasure or pain following it. Those points are treated in a relatively obscure way by Aristotle, especially in comparison with their treatment in the expositions of other character virtues in the Nicomachean Ethics. Building on the expression ‘capacity towards the other’ (δύναμις ἐν (...) τῷ πρὸς ἕτερον), the paper highlights the interpersonal nature of the circumstances of just and unjust actions, and points how such nature is directly related to notions such as ‘profit’ (κέρδος) or ‘getting more’(πλεονεκτεῖν) as well as to the unusual conception of excess, defect and intermediacy in Nicomachean Ethics Book V. The interpersonal nature of just and unjust actions works also as the starting-point for the interpretation both of the pleasure briefly mentioned in 1130b4 as characterizing the greedy person and of the emotion involved in acting justly or greedy, which is mentioned in an extremely elliptical way in 1130b1-2: the paper argues, on the one hand, that the pleasure felt in acting justly or unjustly concerns not only the goods that are the object of just or unjust interactions, but also the way such interactions affect the people involved; on the other hand, it argues that the emotion actuated in just or unjust interactions relates to the agent’s concern or lack of concern with the good of those people. The objective of this paper will be to present a critical evaluation of the so-called “standard conception of a proof”. According to this conception, a text could only be called a “demonstration of a certain mathematical proposition” if we could find a completely formalized version of that demonstration, its “corresponding formal proof”. We will compare these ideas with the treatment of the same topic within two markedly different contexts, that of contemporary Swedish intuitionism and that of modern software engineering. Finally, (...) we will offer a quick discussion of some of Wittgenstein's proposals regarding the subject. /// -/- O objetivo deste texto será o de apresentar uma avaliação crítica da assim chamada “concepção estândar” do que seja uma prova. Segundo essa concepção, um texto só poderia ser chamado de uma “demonstração de uma certa proposição matemática” se pudéssemos encontrar uma versão completamente formalizada daquela demonstração, sua “prova formal correspondente”. Faremos comparações com o tratamento do mesmo tópico em dois contextos muito distintos, aquele do intuicionismo sueco contemporâneo e o da moderna engenharia de software. Wittgenstein’s philosophy of mathematics involves two highly controversial theses: the idea that mathematical propositions are not about (abstract) objects and the idea that no mathematical conjecture is ever answered as such, because the advent of the proof always determines a semantical shift of the meanings of the terms involved in the conjecture. The present article offers a reconstruction of Wittgenstein’s arguments supporting these theses within a very restricted setting: Archimedes’ discovery of an algorithm for calculating the number Pi.

O presente artigo recupera as noções de guerra de raças e de biopoder nas lições ministradas por Michel Foucault no Collège de France intituladas Il faut défendre la Société (1976), para refletir sobre a relação entre neoliberalismo e violência política. Nesse sentido, interessa-me examinar como o pensamento de Foucault formulou o problema do biopoder vinculado ao da violência de raça para analisar nossa atual política (neo)liberal em termos de paradigmas raciais e coloniais.

Many theists conceive of God as a perfect being, i.e., as that than which none greater is metaphysically possible. On this grand view of God, it seems plausible to think that such a supreme and maximally great being would not be subject to luck of any sort. Given the divine perfections, God is completely insulated from luck. However, I argue that the opposite is true: precisely because God is perfect, he is subject to a kind of luck called constitutive luck. (...) In this paper, first I provide an analysis of luck and then explain the concept of constitutive luck. I proceed to defend constitutive luck from charges of incoherence and examine a different approach to make sense of this luck. Furthermore, I distinguish between two kinds of constitutive luck and argue that even if God isn’t subject to one kind, evading the second kind is unsuccessful. I offer two ways that God is constitutively lucky and reach a surprising conclusion: a perfect being is the luckiest of all possible beings. (shrink)

Fabro acerca de la dependencia causal como exigencia del ser participado, a través del estudio de algunas de sus obras más importantes al respecto. Buscamos respondernos por qué para el p. Fabro el ser participado exige una causa, y valorar sus argumentos. -/- Como hemos dicho, para nuestro trabajo nos valdremos ante todo del estudio de algunas de las obras más importantes del p. Cornelio Fabro con respecto a la causalidad. The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. We will also argue that the adoption of this thesis profoundly (...) alters the traditional way of con-struing the idea of “progress” in mathematics. (shrink)

Margaret Urban Walker argues that hospital ethics committees should think of their task as "keeping moral space open." I develop her suggestion with analogies: Enlarge the windows (i.e., expand what counts as an ethical issue); add rooms and doors (i.e., choose particular issues to engage). Examples include confidentiality defined as information flow, and moral distress in the healthcare workplace.

This article was produced as an introduction to a Portuguese translation of an article by Henri Poincaré titled "The new conceptions of matter". The aim of this introduction was to shortly summarize Poincaré's scientific and philosophical production, to approach the circumstances on which the text was originally presented and, finally, to analyze the relationship - or the lack of it - that Poincaré establishes between science and materialism.

As schools publicly modernize in response to societal changes, additional teaching and learning methods are developed, observed, and used since learners have different learning styles that make it easier for them to grasp and retain the material. During the COVID-19 pandemic, teachers require different media to keep the classroom involved while presenting the lesson materials online, one of which is video tutorials. The purpose of this study was to analyze the extent of contextual effects of video tutorials used in general (...) chemistry, determine the relationship between video tutorial effectiveness and the respondents' academic performance, and analyze the significant difference between the four indicators of contextual effects of video tutorials and the respondents' profile. A descriptive-correlational quantitative research design was used in this study. The participants in this study were 144 Grade 12 STEM students from a private school in Sultan Kudarat, Philippines, who took their general chemistry course during the pandemic. The respondents were given a survey questionnaire created with Google Forms. The students agreed with all the assertions and rated them as effective in terms of their perceptions of general chemistry, implying that video tutorials are useful in teaching the subject. With p-values of .023, .046, and .010, respectively, the findings revealed a significant relationship between the overall mean of students' perceptions of the subject of General Chemistry, the concept and application of chemical knowledge and understanding, and their influence on students' academic performance. In terms of their perception, ideas, and application of chemical knowledge and comprehension, the results demonstrated that there is no statistically significant difference between the general mean of male and female students' responses. This basically means that by using video lectures, STEM students of all genders appreciate and understand General Chemistry as a subject. -/- . (shrink)

Over the past fifteen years there has been a considerable amount of debate concerning what theoretical population dynamic models tell us about the nature of natural selection and drift. On the causal interpretation, these models describe the causes of population change. On the statistical interpretation, the models of population dynamics models specify statistical parameters that explain, predict, and quantify changes in population structure, without identifying the causes of those changes. Selection and drift are part of a statistical description of population (...) change; they are not discrete, apportionable causes. Our objective here is to provide a definitive statement of the statistical position, so as to allay some confusions in the current literature. We outline four commitments that are central to statisticalism. They are: 1. Natural Selection is a higher order effect; 2. Trait fitness is primitive; 3. Modern Synthesis (MS)-models are substrate neutral; 4. MS-selection and drift are model-relative. (shrink)

In this work we present the function and we determine the nature of conventions and hypotheses for the scientific foundations according with the conventionalist doctrine that arose in France during the turning of the XIX century to the XX. The doctrine was composed by Henri Poincaré, Pierre Duhem and Édouard Le Roy. Moreover, we analyze the relation that conventions and hypotheses can establish with metaphysical thesis through criteria used by scientists in order to determine the preference for certain theories. Thereunto, (...) we promote an immanent interpretation of published works between 1891 and 1905. As result, we reveal that the authors, though being classified as belonging to the same doctrine, don't have only common grounds, but also divergences. Poincaré and Le Roy agree that geometrical conventions are chosen in accordance with convenience criteria. However, they disagree about the value convenience aggregate to scientific knowledge. In regards to natural phenomena, the three authors agree that reality can't be described univocally by the same set of conventions and hypotheses. Yet, Poincaré and Duhem both believe that there are experimental, rational and axiological criteria that justify scientist's satisfaction with certain theories and we indicate how those criteria are related with metaphysics. We conclude that conventionalists, even if warily and implicitly, searched to approach metaphysics in order to justify scientific activity. (shrink)

A lo largo del siglo XX, y en especial a partir del desarrollo de la física cuántica y de la dinámica no lineal, los conceptos de incertidumbre, impredictibilidad e indeterminación han sido fuente de gran confusión, pese a sus distintos significados y aplicaciones. Un somero análisis de las teorías que los emplean permite distinguirlos con suficiente claridad.

O presente artigo tem como tema as extensas discussões de Wittgenstein sobre uma das formas mais simples e elementares de infinitude em matemática: as dízimas periódicas. Tentamos organizar os vários argumentos do autor em uma única exposição continuada. No final do artigo, introduzimos, ainda que de forma breve, o famoso argumento sobre “execução de regras” de Wittgenstein, bem como a idéia de interpretações nãostandard de processos infinitos.

Analisa a forma com a qual o selo postal brasileiro contribuiu para a construção de representações da religião católica em relação a outras práticas religiosas. Foi considerado, para isso, a concepção deste artefato enquanto media, texto semiótico e sua estreita relação com o discurso religioso. O corpus é composto por selos postais comemorativos brasileiros emitidos durante o século XX. A sua identificação e análise foi feita a partir do catálogo RHM. Entre o ano de 1900 e 2000, os Correios emitiram (...) 2354 selos postais do tipo comemorativo. A partir da observação e identificação de recorrências religiosas foram compilados 222 selos postais comemorativos. O estudo correlacionou a recorrente temática religiosa com o contexto histórico brasileiro, considerando o declínio do catolicismo como maioria religiosa no país e às representações das práticas religiosas nas mídias. A conclusão indica a influência da Conferência Nacional dos Bispos do Brasil, junto ao Ministério das Comunicações e dos Correios do Brasil, consagrando e enaltecendo a visibilidade de personalidades, eventos e a práxis católica, como um discurso único e superior às demais práticas religiosas. A common objection to probabilistic theories of causation is that there are prima facie causes that lower the probability of their effects. Among the many replies to this objection, little attention has been given to Mellor's (1995) indirect strategy to deny that probability-lowering factors are bona fide causes. According to Mellor, such factors do not satisfy the evidential, explanatory, and instrumental connotations of causation. The paper argues that the evidential connotation only entails an epistemically relativized form of causal attribution, not (...) causation itself, and that there are clear cases of explanation and instrumental reasoning that must appeal to negatively relevant factors. In the end, it suggests a more liberal interpretation of causation that restores its connotations. Una objeción común a las teorías probabilísticas de la causalidad es que aparentemente existen causas que disminuyen la probabilidad de sus efectos. Entre las muchas respuestas a esta objeción, se le ha dado poca atención a la estrategia indirecta de D. H. Mellor (1995) para negar que un factor que disminuya la probabilidad de un efecto sea una causa legítima. Según Mellor, tales factores no satisfacen las connotaciones evidenciales, explicativas e instrumentales de la causalidad. El artículo argumenta que la connotación evidencial sólo implica una forma epistémicamente relativizada de atribución causal y no la causalidad misma, y que hay casos claros de explicación y razonamiento instrumental que deben apelar a factores negativamente relevantes. Se sugiere una interpretación más liberal de la causalidad que reinstaura sus connotaciones. (shrink)

: To address the question “on what there is” raised by Quine, and to accomplish the task of comprehending exhaustively the many ontological units that populate the great province of Being, we propose as an alternative to Puntel’s ontology a new ontology designated as “Structural Ontology” (SO). Such ontology is based on systematic-structural theoretical foundations, but leads to a diverse view in which structured factual units, structural configurations (dynamics), as well as apparent ontological units (objects), all encompassed by the temporal (...) sub-dimension that interconnects them, understood as an internal sub-dimension of the macro-dimension of Being, co-subsist. In this sense, we begin by situating the ontological theme in current philosophical discussion from a Quinean perspective. We then present a concept of truth derived from our reading of puntelian philosophy, which will be the point of connection between language and the world. Subsequently, we show how from the concept of truth, after a brief foray into philosophical semantics, we arrive at the ontological field from the ontological categories of structure and ontological state. Finally, we outline, in its general features, our structural ontology, which includes its own ontological notions that give new directions to philosophical understanding of this great theme. Assume que o estudo da produção científica pode oferecer entendimento sobre os temas abordados, tendências da comunidade, autores mais citados, indicação de maturação da área e consolidação ou silenciamento da área. Tem como objetivo mapear como a Filosofia está contida na Ciência da Informação brasileira. Coleta os dados dos artigos científicos publicados entre 1972 e 2018 na Coleção de Publicações Brasileiras em Ciência da Informação - BRAPCI. Analisa uma amostra de 300 artigos e deriva algumas questões descritivas. Conclui que a (...) Ciência da Informação brasileira mantém um discurso filosófico ocidental canônico com uso equilibrado de autores e principais correntes filosóficas. Não aponta ao uso de pensadores e temas periféricos. Propõe a continuidade desse tipo de pesquisa para incentivar debates sobre uma relação interdisciplinar saudável entre Ciência da Informação e Filosofia. (shrink)

El presente artı́culo tiene por objetivo el análisis de los cuerpos en su ex-posición, dado que la condición contemporánea de éstos resulta paradójica: cuerpos expuestos a los que se les impide aparecer. En otras palabras, mientras los mecanismos neoliberales han hecho de su ex-posición una condición fundamental al vincularla a la precariedad, las mismas tecnologı́as de poder han construido y reforzado precondiciones que impiden la aparición de los cuerpos, expulsándolos e incluso aniquilándolos. Bajo este panorama, la primera parte estará dedicada (...) a una revisión del contexto neoliberal que da sustento al problema, para luego ahondar en sus consecuencias y, finalmente, desembocar en la necesidad de aliarse como modo de resistencia. Las alianzas corporales serán, en efecto, un imperativo en la lucha por derechos compartidos, ası́ como un retorno a la que es quizá una de las condiciones fundamentales de la corporalidad: su vinculación con otros cuerpos. Review of the translation of Ludwig Wittgenstein book: Observações Filosóficas. São Paulo: Edições Loyola, 2005. Tradução (do inglês) por Adail Sobral e Maria Stela Gonçalves.

In this paper we explore the absentminded driver problem using two different scenarios. In the first scenario we assume that the driver is capable of reasoning about his degree of absentmindedness before he hits the highway. This leads to a Savage-style model where the states are mutually exclusive and the act-state independence is in place. In the second we employ centred possibilities, by modelling the states (i.e. the events about which the driver is uncertain) as the possible final destinations indexed (...) by a time period. The optimal probability we find for continuing at an exit is different from almost all papers in the literature. In this scenario, act-state independence is still violated, but states are mutually exclusive and the driver arrives at his optimal choice probability via Bayesian updating. We show that our solution is the only one guaranteeing immunity from sure loss via a Dutch strategy, and that – despite initial appearances – it is time consistent. This raises important implications for the rationality of commitment in such scenarios. (shrink)

Inicialmente se caracteriza una noción de explicación que hace referencia a las creencias y fines epistémicos de los miembros de una comunidad científica. Posteriormente se demuestra que la inclusión de los aspectos pragmáticos de la explicación en la teoría no sólo no conduce al relativismo, sino que es necesaria para poder dar cuenta de la (...) relación entre las nociones de explicación y comprensión. >e paper studies the discussion about human good in Eudemian Ethics I.7. It is particularly concerned with the existence, in the text, of two characteristics of the human good: its peculiarity, on the one hand, which consists not only in the quali- (cation ‘human’ (anthropinon), but also in the assignment of this good to the domain of action (the activity that distinguishes humans from other beings), and, on the other hand, the fact that it belongs to a spectrum containing the (...) goods of other beings, like god and the remaining living beings. Divinity works as the standard for the distinction between eudaimonic goods – belonging to beings whose nature implies participation in the divine (humans, for example) – and non-eudaimonic goods that belong to those beings deprived of such participation. Resorting to other passages from the Eudemian Ethics, as well as other texts from the corpus, the paper defends that the two characteristics of the human good presented in EE I.7 foreshadow an important di?erence between the two Aristotelian treatises on eudaimonia: whereas the Nicomachean Ethics emphasizes contemplation as the activity through which humans participate in the divine, the Eudemian Ethics stresses virtuous actions as a human activity related to the divine. Fenomenologia della percezione (1ª ed. 1941, 2ª ed. 1961) è, a mio parere, un libro fondamentale, che ci può orientare in modo decisivo davanti alla dialettica idealismo - realismo (60). Infatti, il principio di immanenza, da Cartesio a Gadamer, si basa su una sbagliata e gratuita descrizione del punto di partenza della conoscenza. In questa concezione, la conoscenza partirebbe da una materia informe, o un polverone di elementi che deve essere organizzato in qualche modo dal soggetto. L’esperienza ci dà la (...) molteplicità, e l’unità non può venire che dal soggetto. Ora, qual’è l’esperienza sulla quale si basa questa asseverazione? Nessuna, ovviamente, ed p. Fabro si incarica di provarlo fino alla stanchezza nelle 400 pagine che compongono la sua colossale opera. Il punto di partenza dell’idealismo non è per niente fuori discussione, e per convincersi basta prendere tra le mani questo libro. (shrink)

Following Michael S. Jones’ call for articles showing the contemporary value of the great 20th century Romanian philosopher Lucian Blaga in various spheres of expertise, I have immediately thought of George F. Steiner’s recently published book, Neanderthals in Plato’s Cave. The evolutionary model forwarded by Steiner draws heavily on philosophical insights provided by Blaga and, although the volume was written for a scientifically-minded public, the author has adopted, updated and expanded some of Blaga’s anthropological perspectives. In our e-mail correspondence, Steiner (...) has acknowledged Blaga’s influence and has enthusiastically endorsed my attempt to review the similarities between some of the postulates of contemporary research in the various disciplines that inform cognitive archaeology – Steiner’s field of expertise – and the conceptual evolutionary/cultural hypothesis outlined in Blaga’s philosophical system. O pressuposto está baseado na observação e no diálogo em sala nas disciplinas sobre pesquisa, ciência e filosofia ofertadas nos Cursos de Graduação em Biblioteconomia e de Pós-Graduação em Ciência da Informação da Universidade Federal de Pernambuco. Este artigo tem como objetivo propor um debate conceitual sobre arquivos a partir (...) de Michel Foucault e com algumas referências das áreas supracitadas. O procedimento metodológico foi exploratório e bibliográfico. Conclui que o senso comum estudantil não concebe o fazer científico com o debate conceitual. Colabora com a produção de bibliografia didático-teórica para uso dos estudantes. Põe em prática certa versão de confrontamento de conceitos que possam ser esboçadas, compartilhadas e debatidas, pois disso trata o arquivo, propriamente dito. (shrink)

This text is the final work of researches around the themes of media and crime. Through analyses of articles published by different newspapers (season) São Carlos/SP try to understand the different representative constructions made by the local press in trying to build an entire sphere in favor of the trial and conviction of all accused to make part of the “Gang Mangano”. As a powerful vehicle of communication to the press, at that time, sought to protect socalled “good men” of (...) the time, which in general were those individuals who were part of the local elite. In this sense, choosing to cut a discourse around the concept of social/collective representations tried to prolematize this concept with the media and crime issues in an attempt to discern the main argumentative construction and training of social imaginary collective. La literatura sobre razonamiento probatorio busca incidir en la determinación de los hechos en los procesos judiciales. Para alcanzar dicho propósito, no basta con dirigir la mirada hacia disciplinas extrajurídicas exitosas e integrar lo que de ellas pueda extraerse a las teorías jurídicas de la prueba y a la práctica judicial. Es necesario, además, considerar el tipo de hechos a probar, los roles de las reglas jurídicas aplicables, y asumir que litigantes y jueces, actuando en un contexto institucional, podrán ser (...) más o menos agudos en la discusión fáctica, entre otras cosas. Minimizar la influencia de tales factores expone a los estudios probatorios a tener un bajo rendimiento práctico. Algo de esto ha ocurrido con la llamada concepción racionalista de la prueba. Su innegable aporte al debate académico en español no ha ido a la par de su impacto judicial. Para explicar esta brecha entre teoría y práctica, identificamos tres creencias-obstáculo que afectan a su discurso sobre la prueba y que deben ser sorteadas si lo que se busca es influir en la forma en que se juzgan los hechos en un sistema judicial realmente existente. En este artículo defiendo que la concepción rawlsiana de la justicia distributiva va más allá de los márgenes de la justicia asignativa y que esta presenta buenos argumentos para hacer frente a las demandas de reconocimiento. Para alcanzar este objetivo, en primer lugar muestro que algunos críticos del paradigma liberal distributivo malinterpretan la concepción de la justicia distributiva elaborada por Rawls y reducen su finalidad a un mero reparto de bienes. Al hacer lo anterior, ellos no logran comprender la dimensión (...) moral de la propuesta rawlsiana, propuesta firmemente asentada en la idea de reconocimiento. En segundo lugar, analizo la relevancia que tienen las nociones de reconocimiento recíproco y autorrespeto en la teoría de la justicia de Rawls, para finalmente mostrar cómo a partir de ellas se puede reinterpretar la finalidad de la justicia distributiva e incluir las demandas de reconocimiento. AbstractThe paper reviews the english translation of the Eudemian Ethics made by Anthony Kenny, which was published in 2011. (...) The Review presents a general overview of the translation (its context and general traits), as well as a non exaustive analysis of some aspects of the work: the translation of some key concepts of aristotelian ethics, and of some phrases containing the main argument of the treatise, that concerning the happy life. El carácter fundamentalmente probabilista de la teoría cuántica cuestionó el realismo como filosofía básica de la ciencia, si bien ciertas interpretaciones instrumentalistas podrían no amenazar por sí solas la existencia de un mundo exterior e independiente de nuestra conciencia. La falta de un valor definido para tales magnitudes antes de la medición alentó la suposición de que tales valores “no existen” antes de la medida. Una reinterpretación de nuestras ideas sobre las magnitudes físicas, considerándolas formalmente representadas por conjuntos de valores (...) en lugar de valores numéricos concretos, ayudaría a disipar toda sombra de irrealidad física. Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. Finally, with the help of some brief case studies, the author hopes to provide a minimum framework useful to understand how social justice can be realized through law. (shrink)
